Last updated: 21.10.2026

Publication location: qusim.online

This User Agreement is an official public offer (Public Offer under Article 395 of the Civil Code of the Republic of Kazakhstan) by the owner of this Website (an individual entrepreneur / LLP) (the “Seller” or “Provider”), addressed to any individual or legal entity (the “User” or “Buyer”) that accepts the terms of this offer.

Under Article 396 of the Civil Code of the Republic of Kazakhstan, registering an account, making a payment, or downloading/activating an eSIM QR code on the Website constitutes full and unconditional acceptance of this offer.

1. Terms and definitions

1.1. Website / Account — the Seller’s web resource available at qusim.online, intended for selecting, paying for, and accessing eSIM digital products.

1.2. eSIM — an integrated digital SIM profile that allows the User to connect to mobile networks without using a physical plastic SIM card.

1.3. Infrastructure Provider (eSIMAccess) — ESIM ACCESS LIMITED (Hong Kong, address: Flat/Room 8, 15/F, Witty Commercial Building, 1A-1L Tung Choi Street, Kowloon, Hong Kong), which provides international technical infrastructure, the SM-DP+ platform, and data plans.

1.4. Data Plan (eSIM Plan) — a digital product containing a specified amount of mobile Internet traffic, valid in specified countries/regions for a set period.

1.5. eSIM QR code — an electronic activation key provided to the User to download an eSIM profile onto a compatible device.

2. Subject of the agreement and Seller status

2.1. The Seller provides the User with an information technology service for selecting, paying for, and receiving eSIM digital profiles and data plans for use in international roaming.

2.2. Independent reseller status: the User is informed and agrees that the Seller is an independent commercial agent (reseller) of the Infrastructure Provider (esimaccess.com).

2.3. Direct communication services, Internet traffic routing, base station operation, and GSMA infrastructure support are provided by the Infrastructure Provider and its international partners (mobile operators in the countries visited). The Seller is not a telecommunications operator in the Republic of Kazakhstan or any other state unless expressly provided by law.

3. Acceptance procedure and account registration

3.1. To place orders, the User registers an Account and provides a valid email address and contact details.

3.2. The User is fully responsible for keeping the login and password secure and for all actions performed in the Account under the User’s credentials.

3.3. The Seller may restrict access to the Account if it detects signs of fraud, unauthorized access, or violation of this Agreement.

4. Device compatibility and usage rules (Fair Usage Policy)

4.1. Compatibility check: before making a payment, the User must independently check and confirm that the mobile device:

  • Supports eSIM technology;
  • Has no factory or carrier restrictions (Carrier Unlocked / SIM-Lock).

4.2. Service purpose: data plans are intended exclusively for standard personal (consumer) use on smartphones and tablets during short-term trips and travel.

4.3. Prohibited and improper use (Abnormal Traffic Consumption):

eSIM may not be used:

  • In routers, 3G/4G/5G modems, USB dongles, stationary access points, IoT equipment, or other high-load devices;
  • To continuously replace local wired or mobile Internet in one country on a permanent basis outside the context of travel;
  • For commercial redistribution, traffic resale, spam campaigns, automated scripts, botnets, or activity that threatens network stability;
  • In the event of abnormally high and continuous usage (consumption of 70–100% of the allocated traffic quota in an extremely short period).

4.4. If improper or abnormal use is detected, the Infrastructure Provider and the Seller may, without prior notice:

  • Limit data transfer speed under the Fair Usage Policy;
  • Suspend or fully cancel service for the specific eSIM profile without compensation.

5. Price, payment procedure, and refunds

5.1. Payments for digital products on the Website are made in tenge (KZT) or another currency shown on the Website through authorized payment organizations/acquirers.

5.2. The Seller independently sets retail prices for Products and may change them unilaterally until the User pays for an order.

5.3. Digital nature of the product and refunds:

  • Under the Law of the Republic of Kazakhstan “On Protection of Consumer Rights”, a digital code (eSIM QR code) generated, provided in the Account, or sent to the User’s email is a digital product of proper quality that is not refundable after delivery to the Buyer.
  • No refund is made if the User’s device does not support eSIM technology, is blocked by a mobile operator, or the User changes their mind after receiving the QR code.
  • A refund or Product replacement is possible only after support verifies a confirmed technical failure on the Infrastructure Provider’s side, where the QR code was not activated and the service could not be provided for server-side technical reasons.

6. Technical support and connection quality

6.1. The Seller provides User support for Website operation, payments, and QR code delivery through the contacts shown in the Account.

6.2. Complaints about connection quality, coverage, and eSIM profile operation are accepted by the Seller and forwarded to the Infrastructure Provider’s 24/7 technical service (esimaccess.com).

6.3. The User understands that roaming connection quality depends on local partner operator coverage, terrain, weather, smartphone specifications, and other factors outside the Seller’s direct control.

7. Limitation of liability

7.1. Under the applicable laws of the Republic of Kazakhstan, the Seller is not liable for indirect, incidental, or consequential losses, lost profit, lost business income, or moral harm caused by communication interruptions or inability to use eSIM.

7.2. Liability cap: the Seller’s total liability for any claims or lawsuits related to this Agreement is limited to the amount actually paid by the User for the specific disputed Order (Data Plan).

8. Personal data protection (consent to collection and processing)

8.2. Personal data is collected and processed to perform this Agreement, provide Account access, process payments, and communicate with the User.

8.3. The User confirms consent to transfer necessary technical and identification data to the Infrastructure Provider (ESIM ACCESS LIMITED, Hong Kong) only to the extent required to activate eSIM and provide communication services.

9. Export controls and international sanctions

9.1. The User must comply with applicable export control and international sanctions rules, including restrictions imposed by the UN, the United States, the EU, the United Kingdom, and Hong Kong.

11.1. The Seller may unilaterally amend this Agreement. Amendments take effect when published on the Website.

11.2. The relations between the Parties are governed by the applicable laws of the Republic of Kazakhstan.
